Terms of Service

Welcome! Please read the Terms of Service (aslo called "Terms") carefully so you understand the rules that govern your use of any products or services we create. Remember that the Terms form a legally binding contract between you and Saturday Technologies Incorporated ("Saturday", "we", "us").

By using or accessing Saturday or any product or service provided by us (collectively called the "Service"), you are agreeing to these Terms.

If you do not agree with the Terms, then please do no use the Service.

1. Basic Terms

  1. You must be at least 13 years old to use the Service.
  2. You will not create more than one account for yourself.
  3. You will not create an account for yourself if you have previously been banned from the Service, unless you have written permission from Saturday.
  4. You will not post pornographic, nude, partially nude, violent, unlawful, hateful, or infringing content.
  5. You're responsible for any activity that occurs through your account.
  6. You're solely responsible for your conduct and any data, text, information, usernames, profiles, photos, audio, video clips, links ("Content") that you submit, post, or display on the Service.
  7. You're responsible for keeping your password secure.
  8. You will not threaten, harass, abuse, intimidate, or impersonate other users.
  9. You will not use the Service for any purpose that is illegal or prohibited in these Terms. You will comply with all applicable local, state, provincial, national, and international laws, rules, and regulations.
  10. You will not modify or hack another application or website so as falsely imply that it is associated with Saturday.
  11. You will not access Saturday's private API in any way other than via Service made available by Saturday.
  12. You will not use any robot, crawler, scraper, or other automated means or interface to access the Service and cache any content from Saturday, including but not limited to other user's information.
  13. You will not spam or solicit any user of the service.
  14. You will not use viruses, spyware, malware, or other code of a destructive or disruptive nature to interfere or disrupt either (a): any servers or networks connected to the Service or (b): the Service itself such that the Service rendered in user's device or browser is modified or interrupted.
  15. You will not use or develop any third-party application that interacts with the Service or other users' content or information without written consent from Saturday.
  16. If you violate any of these terms, your account associated with the Service will be terminated.
  17. While Saturday prohibits conduct and Content that infringes on these Terms, you understand and agree that Saturday cannot be held responsible for the Content generated by users of the Service, and that you may be exposed to such materials and you use the Service at your own risk.

2. Rights You Grant To Saturday

  1. Saturday is constantly working on the Service, and that means products, features, and functionalities may be added, changed, or removed at any time. Saturday reserves the right to modify or terminate the Service for any reason without notice at any time.
  2. Saturday reserves the right to alter the Terms at any time. If necessary, Saturday will notify you of any changes by email.
  3. Saturday can deny the Service to anyone for any reason at any time.
  4. Saturday can reclaim your username for any reason at any time.
  5. Saturday may, but has no obligation to, remove Content and accounts containing Content that infringe on these terms or are otherwise objectionable or violates intellectual property.
  6. By submitting any feedback or suggestions, you grant Saturday the right to use your ideas without compensation.

3. Content

  1. Saturday doesn't claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or other material (together, "Content") that you post on or through the Service.
  2. By displaying or publishing ("posting") any Content via the Service, you hereby grant to Saturday a worldwide, non-exclusive, fully paid, royalty-free, sub-licensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute such Content.
  3. You warrant that: (a): you are the owner of the Content that you post on or through the Service or otherwise have the right to grant license set forth in this section, (b): the posting and use of your Content via the Service doesn't violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person, and (c): the posting of your Content on the Service doesn't breach any contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owning any person by reason of Content you post on or through the Service.
  4. The Service contains content belonging to Saturday ("Saturday Content"). Saturday Content is protected by copyright, trademark, patent, trade secret, and other laws. Saturday owns and retains all rights in the Saturday Content and the Service. Saturday hereby grants you a limited, revocable, nonsublicensable licensable to reproduce and display the Saturday Content (excluding any software code) solely for your personal use in connection with using the Service.
  5. The Service contains content generated by other users ("User Content"). Except as provided within this Agreement, you can't copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any User Content made available via the Service.
  6. While Saturday intends for the Service to be available all the time, there will be times when the Service may be interrupted for scheduled maintenance, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Saturday. Saturday will not be liable to you for any modification, suspension, or discontinuation of the Service.
  7. While Saturday reserves the right to remove any Content from the Service that violates the Terms, Saturday also reserves the right to delete any content for any reason without prior notice. Deleted content may be stored by Saturday in order to comply with certain legal obligations and is not retrievable without a valid court order. Saturday is not a backup service and you'll have to maintain your own backup. If you want to keep all your videos, make sure to turn on "Save Videos After Recording" in the mobile application settings. Saturday will not be liable to you for the loss of any Content.
  8. You understand and agree that the Internet may be subject to breaches of security and that the submission of Content or other information may not secure.

4. Privacy

Saturday values your privacy. To learn about how Saturday handles your personal information when you use the Service, please read over the Privacy Policy. The Privacy Policy governs how Saturday can collect, use, and share your information, so read it carefully.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SATURDAY TECHNOLOGIES INCORPORATED AND ITS managing MEMBERS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, LICENSORS, AND SUPPLIERS (COLLECTIVELY, THE "SATURDAY PARTIES") WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, FINANCIAL, OR INCIDENTAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) THE CONDUCT OR CONTENT OF OTHER USERS OR THIRD PARTIES ON OR THROUGH THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF SATURDAY TECHNOLOGIES INCORPORATED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Disclaimers

The Service, including, without limitation, Saturday Content, is provided on an "as is", "as available" and "with all faults" basis. To the fullest extent permissible by law, the Saturday Parties don't make any representations or warranties or endorsements of any kind whatsoever, express or implied as to: (a) the Service; (b) the Saturday Content; (c) User Content; or (d) security associated with the transmission of information to Saturday or via the Service. In addition, the Saturday Parties hereby disclaim all warranties, express or implied, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, non-infringement, title, custom, trade, quiet enjoyment, system integration, and freedom from computer virus.

The Saturday Parties do not represent or warrant that the service will be error free or uninterrupted; that defects will be corrected; or that the service or the server that makes the Service available is free from any harmful components, including without limitation, viruses. The Saturday Parties do not make any representations or warranties that the information (including any instructions) on the Service is accurate, complete, or useful. You acknowledge that your use of the Service is at your own sole risk. The Saturday Parties do no warrant that your use of the Service is lawful in any particular jurisdiction, and the Saturday Parties specifically disclaim such warranties. Some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to you to the extent such jurisdiction's law is applicable to you and these terms of service.

By accessing or using the Service, you represent and warrant that your activities are lawful in every jurisdiction where access or use the Service.

The Saturday Parties do not endorse content and specifically disclaim any responsibility or liability to any person or entity for any loss, damage (whether actual, consequential, punitive, or otherwise), injury, claim, liability, or other cause of any kind or character based upon or resulting from any content.
